0005172: Hammering gets downgraded to beating if no restraint (rope/chain) has been built
An dwarf accused of 8 murders has after each only received a beating by the captain of the guard. The vampire now has "no sentence pending" and is free to strike again.

The captain is wielding a war hammer, and the hammerer position has been appointed -- but yet no hammering has been applied.
1. Wait for vampire immigrant to appear and murder
2. Accuse a dwarf (preferably the guilty party) of the murder
3. Watch a light sentence be administered by the justice system

Yeah, this is a problem. My vampire got sentenced to 200 days in prison for two murders. No death sentence. I locked him in so he can't strike again, but he doesn't seem to be dying of thirst/hunger so all I can do is to keep him imprisoned behind the locked door for eternity.

Got one sentenced to 100 hammerstrikes. Now it's been downgraded to a beating.

HammerDave: unless it's changed since 40d, hammerstrikes can only be delivered to dwarves that are restrained in a Jail (which prevents then from getting away).

Building a restraint (iron chain in my case) resolved the problem, for the next murder. The hammerer dragged the accused to a chain, went to get a hammer, and then started whacking away.

I'd like to leave this in bug status though. Instead of just downgrading the sentence, shouldn't we get a cancel message with "no restraint available"? Back in the day when the most common kind of criminal was a random craftsdwarf charged with violating production orders due to an unreasonable demand, it made sense to exploit the justice system to force downgraded sentences. But now, when a vampire kills my legendary stonecrafter I want justice.

There is also opportunity for a more dwarven response from the hammerer. We should get a "build a restraint" demand and he should go nuts if you don't satisfy it. :D But that's new function IMO.

HammerDave: A variant of "build a restraint" actually exists in the form of an unhappy thought for the Sheriff/Captain of the Guard if you have insufficient jails, though it's currently broken due to 0005844. Perhaps a variant could be added to the Hammerer that insists on a certain number of jails being restraints instead of cages.
